16.11.2011 By this petition the Petitioner seeks quashing of FIR No. 38/2010 under Sections 63/68A/65 Copyrights Act 1957 registered at PS Mangolpuri, Delhi and the proceedings emanating thereform. The complainant/Respondent No. 2 is represented by its authorized representative Shri D. Basu and is identified by the learned counsel. The copy of the resolution passed by the Board of Directors is placed on record by the learned counsel and is marked as Ex.'C. Mr. D. Basu the authorized CRL.M.C. 3763/2011 Certify that the digital file and physical file have been compared and the digital data is as per the physical file and no page is missing. \ representative of the Respondent No.2 who is present in Court states that Respondent No.2 has settled the matter before the Delhi High Court Mediation and Conciliation Centre. Copy of the settlement agreement is enclosed as Annexure P-2. In terms of the settlement the Petitioner had paid a sum of Rs. 9,25,000/- in Court today by way of demand draft No. 375634 dated 12"' October,2011 drawn on IndianBank in full and final settlement of all the claims of the Respondent No.2. In view of the settlement between the parties, the Respondent No.2 does not want to pursue the abovementioned FIR and the proceedings pursuant thereto. In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful purpose will be served in continuance of the proceedings, rather the same would create further acrimony between them, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. Consequently, FIR No. 38/2010 under Sections 63/68A/65 Copyrights Act 1957 registered at PS Mangolpuri, Delhi and proceedings pursuant thereto are hereby quashed.
