28.11.2011 Crl.M.A. 18478/2011 Exemption allowed subject to just exceptions. CRL.M.C. 3921/2011 By this petition Petitioner No. 1 & 2 who are the accused in FIR No. 182/2010 under Sections 468/471 IPC registered at PS Daryaganj, Delhi seek quashing of FIR lodged on the complaint of Petitioner No.3. The Petitioner No.3 states that the main matter i.e. the matrimonial dispute between his daughter and the Petitioner No.1 have already been CRL.M.C. 3921/2011 Certify that the digital file and physical file have been compared and the digital data is as per the physical file and no page is missing. settled and in terms thereof an FIR under Section 498A/406/34 IPC has been also quashed today. The present FIR is an offshoot of the same matrimonial dispute. Learned APP for the State has objected to the quashing of FIR in view of the fact that the forged stamp of the Police station was used to show the receipt of the complaint. Petitioner No.3 who is present in Court and is identified by his counsel states that in view of the settlement arrived at between the parties, he does not want to pursue the abovementioned FIR and the proceedings pursuant thereto. In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful purpose will be served in continuance of the proceedings, rather the same would create further acrimony between them, it would be in the "---' interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. Consequently, FIR No. 182/2010 under Sections 468/471 IPC registered at PS Daryaganj, Delhi and proceedings pursuant thereto are hereby quashed subject to the Petitioners paying a cost of Rs. 15,000/- each CRL.M.C. 392112011 to the Bar Council of Delhi Advocates Welfare Fund within t from today.
