10.11.2016 CAVEAT No. 924/2016 Since counsel for the caveator has entered appearance, the caveat stands discharged. C.M. Appl. No. 39718/2016 (for exemption) Exemption allowed, subject to all just exceptions. The application stands disposed of. W.P.(C) 10018/2016 and C.M. Appl. No. 39717/2016 (for stay, U/S 151 CPC)

¶1This writ petition is disposed of with the consent order by W.P.(C) 10018/2016 setting aside the order of the Delhi School Tribunal dated 14.9.2016, inasmuch as, the order of the Delhi School Tribunal holds the disciplinary authority constituted by the School as violative of Rules 118 and 120 of the Delhi School Education Rules, 1973 without specifying as to how and in what manner the constitution of the disciplinary committee is violative of Rules 118 and 120. In fact, the judgment of the tribunal is, therefore, a non-speaking judgment and, accordingly, with consent the judgment of the tribunal dated

14.9.2016 is set aside with directions to the tribunal to hear the parties and pass a speaking judgment as to if the disciplinary committee is or is not violative of the provisions of Rules 118 and/or 120 of the Delhi School Education Rules.

¶2Parties to appear before the Delhi School Tribunal on 16th December, 2016.

¶3A copy of this order be given dasti to counsels for the parties. VALMIKI J. MEHTA, J NOVEMBER 10, 2016 AK W.P.(C) 10018/2016
