10.11.2017 Instant petition has come to be filed alleging unauthorized construction in property no. A 19-20, Malka Ganj, Delhi. Petitioner, as per the affidavit accompanying the petition, is aged 28 years and on being queried, ld. counsel for the petitioner states that he is possibly, running a Kiryana shop in Subzi Mandi. He is not said to be a resident of abutting or immediately nearby property, where the alleged unauthorized construction is raised. As per the copies of the communications annexed to the petition, he has written some complaints/letters to the respondent-North Delhi Municipal Corporation for the alleged unauthorized construction getting raised. As per the photographs annexed to the petition, it appears that about six storeyed building is said to have been raised and at the finishing stage. Is it that, till the time the property got raised to such an extent, he remained oblivious of such massive construction? It therefore, becomes doubtful for the petition having been filed bonafide. Be that as it may, during the course of hearing, Ms. Taneja, ld. counsel for the respondent submits that a demolition order has already been passed on 7.7.2017. This information compounds the doubt. Simultaneously however, one wonders as to whether the respondent-North Delhi Municipal Corporation and the police awaiting unauthorized construction getting occupied. The Commissioner, North Delhi Municipal Corporation and Commissioner of Police, Delhi are therefore, directed to look into and take immediate requisite steps, so that the illegal activities are not perpetuated. Petition stands disposed off accordingly. Dasti under the signatures of the Court Master. A. K. CHAWLA, J NOVEMBER 10, 2017 rc
