Judgment
ORDER Date : 09.04.2024 Heard Mr. A.K. Ahmed, learned counsel appearing for the Petitioner. Also heard Ms. N. Das, learned Additional P.P. for the State of Assam. This is an application under Section 439 of the Cr.P.C. in respect of Special NDPS Page No.# 2/2 PS Case No. 28/2023 pending in the Court of Additional Sessions Judge(FTC) cum Special Judge, Lakhimpur, North Lakhimpur. Initially 2.7 kilograms of ganja was found in the possession of the petitioner. Subsequently, on being sown by him 8.8 kilograms of ganja was further recovered. The trial is going on. 4 witnesses have been examined out of 18 cited witnesses. This Court is of the opinion that allowing the petitioner to go on bail at this stage would hamper early disposal of the case before the trial Court. Therefore, the bail prayer of the petitioner is found not to be satisfactory. Accordingly, the bail application stands rejected and disposed of accordingly.
