ORDER

24.01.2024

Heard Mr. P. Sarma learned counsel for the petitioners and Mr. T. R. Gogoi, learned Government Advocate appearing for respondent Nos. 1, 2 and 3. This is an application under Section 5 of the Limitation Act, praying for condoning the delay of 61 days in filing the appeal against the judgment and order dated 31.07.2023 passed by the Additional District Judge, Dhubri in L.A. Case No. 21/2014. It is submitted by the learned counsel for the petitioner that the delay of 61 days in filing the appeal occurred due to official exigencies and prayed for condoning the delay. On the other hand, the learned Government Advocate has no objection in condoning the delay of 61 days in preferring the appeal. Considering the submission of learned counsel for both the parties, delay of 61 days is hereby condoned. Accordingly, this interlocutory application stands disposed of. Registry is directed to register the appeal and list the matter for admission.
