Heard the learned counsel Mr. S. Islam appearing for the petitioner. Also heard Mr. K.K. Das, the learned Addl. Public Prosecutor, Assam. This is an application under Section 439 CrPC whereby the petitioner Page No.# 2/2 Sumit Deb, who was arrested on 27.10.2023 in connection with Borboruah Police Station Case No.120/2023, under Sections 120-B/406/409/420/34 of the IPC, has prayed for releasing him on bail. The petitioner was working as an Accountant in the Abutani Trucking Vahan Pvt. Ltd. He is accused of embezzlement of 1.50 crores of rupees. It is further alleged that the petitioner along with some other employees of the said company have jointly done that offence. The petitioner's earlier bail application was rejected by this Court. Today, is the 90th day of his detention. There is no information as to whether police has filed the charge sheet against him. Thus, he is entitled to be released on default bail. The petitioner Sumit Deb is allowed to go on bail of ₹25,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Dibrugarh. The bail application is disposed of.
