Judgment
ORDER Date : 19.01.2024 Mr. S. M. T. Chistie, learned counsel appearing for the respondents in terms of the earlier order dated 05.01.2024 has placed on record a communication dated
19.01.2024, issued by the In-charge Director Secondary Education, Assam, wherein, it has been held that the petitioner is rendering his services, till date, and Page No.# 2/2 accordingly, the matter was placed before the Government for necessary action. This Court, vide order dated 29.11.2019 passed in WP(C)8405/2018 had required the authorities to cause an examination as to whether the petitioner is rendering his services and if so, to release his salaries. The examination as required has been concluded and the petitioner was found to be rendering his services. Accordingly, this contempt petition need not be pursued further. I am of the opinion that there is substantial compliance of the direction passed by this Court and there is no willful and deliberate violation thereof. The respondent authorities are now required to take the matter forward and release to the petitioner his due salaries in terms of the conclusions as contained in the said communication dated 19.01.2024.
