ORDER

11.03.2024 Heard Mr. H. Agarwal, learned counsel for the petitioner. Also heard Mr. K.K. Parashar, learned Addl. P.P, Assam. Page No.# 2/3 The Case Diary called for has been placed before this Court. It may be mentioned that by Order dated 05.01.2024, this Court granted interim pre-arrest bail to the petitioner subject to the conditions. Mr. K.K. Parashar, learned Addl. P.P submits that the petitioner has appeared before the I.O in terms of the interim pre-arrest bail granted by by this Court earlier. He further submits that the petitioner's statement under Section 161 Cr.PC has been recorded. He submits that it reveals from the information collected by the I.O that the petitioner purchased the subject plot of land at a value which is less than the market value. Considering the fact that the petitioner is co-operating with the investigation, this Court is of the considered view that further custodial interrogation of the petitioner is not required for the on-going investigation. Accordingly, the interim pre-arrest bail granted earlier by this Court vide Order dated 05.01.2024 is hereby made absolute subject of course to the following conditions:-

(i) That the petitioner shall co-operate with the investigation.

(ii) That the petitioner shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any Police Officer; and

(iii) That the petitioner shall refrain from committing any similar Page No.# 3/3 offences in future of which he is accused or suspected of commission. With the above observation and direction, the anticipatory bail application stands disposed of. JUDGE Comparing Assistant
