ORDER 16-02-2024 Heard Mr. P. Bordoloi, learned counsel appearing for the petitioners. Also heard Mr. K. Baishya, the learned Addl. PP, Assam. Page No.# 2/2 This is an application filed under Section 438 of the Cr.PC, in respect of Mukalmua PS Case No. 596/2023 (Corresponding to GR Case No. 2170/2323) under Sections 447/325/506/305/34 IPC. Pursuant to the interim order granted by this Court, the petitioner has appeared before the Investigating Officer and their statements are already recorded. The Addl. PP submits that there are some amount of incriminating materials against the petitioners. I have considered the submissions made by the learned counsel for the parties. Since the petitioners have appeared before the Investigating Officer, they do not deserve to be detained in custody therefore their pre-arrest bail application stands allowed. The interim bail granting on 19.01.2024 is made absolute. The petitioners are directed that they shall cooperate with the investigation as and when required. With the aforesaid observation, the bail petition stands disposed of.
