Krishna Pradhan v. The State of Assam

Heard Mr. L. Gogoi, learned counsel for the applicant and Mr. B. Sharma, learned Additional Public Prosecutor for the State respondent.

¶2Apprehending arrest in connection with Gohpur P.S. Case No. 247/2023, under Sections 447/324 of the IPC, this application under Section 438 of the Code of Criminal Procedure, 1973, is preferred by applicant namely, Sri Krishna Pradhan for grant of pre-arrest bail.

¶3The said case has been registered on the basis of one F.I.R., lodged Page No.# 2/2 by one Jatin Borah, on 12.12.2023. The essence of allegations made in the FIR is that on 11.12.2023, at about 6:45 pm, the accused namely, Krishna Pradhan came to his house and attacked him by a sharp weapon and caused injuries to him.

¶4Mr. Gogoi, learned counsel for the applicant submits that this Court was pleased to grant interim protection to the applicant, vide order dated

09.01.2024, and pursuant to the said order, the applicant had appeared before the IO and has been cooperating with the investigating agency. Mr. Gogoi further submits that in the meantime the IO has completed investigation and submitted charge sheet.

¶5On the other hand, Mr. Sharma, learned Additional Public Prosecutor confirms that the I.O. has completed investigation and laid Charge-Sheet against the applicant, under Sections 447/324 of the IPC, vide Charge-Sheet No. 10/2024, dated 24.01.2024.

¶6In view of above, this anticipatory application stands disposed of by directing the applicant to appear before the learned court below on or before

18.03.2024, and to apply for regular bail and in event of filing such an application, the learned Court below shall consider the same in accordance with law.

¶7Till then, the interim order dated 09.01.2024, stands extended.
