Heard Shri R.C. Saikia, learned counsel for the petitioner. Also heard Ms. M.D. Borah, learned Standing Counsel, Welfare of Minorities & Development Department. When the matter was taken up yesterday, i.e., 08.01.2024, the following order was passed.: "08.01.2024 Paucity of time did not permit this Court to take up the matter today. Shri R.C. Saikia, learned counsel for the petitioner has however submitted that there is not only an urgency but the action sought to be taken by the Director of Char Area Development is prima facie in Page No.# 3/3 contempt of the earlier direction of this Court. In support of the said submission, he has referred to the orders passed by this Court earlier which is operating. He has also referred to the e-tender notice which has been issued despite such orders. The matter appears to be a serious one wherein prima facie, there appears to be a deliberate and willful disobedience of the order of this Court.' List for consideration on 09.01.2024 at 10:15 a.m."

Accordingly, this matter is listed today for consideration. Ms. Borah, the learned Standing Counsel however has informed this Court that the e-procurement system published on 20.12.2023 is cancelled in terms of the interim order earlier passed by this Court on 12.04.2023. Copy of the aforesaid office order dated 06.01.2024 is also placed before this Court. In view of the above development, this Court is of the opinion that there is no requirement for any adjudication in the I.A. I.A. accordingly stands closed.
