Heard Mr. P.K. Das, learned counsel for the applicant. Also heard Mr. B. Sarma, learned Additional Public Prosecutor for the State. The present application has been filed under Section 5 of the Limitation Act, 1963 for condonation of delay of 25 days in preferring the connected revision petition under Section 397/401 Cr.P.C. against the order dated 28/08/2023 passed by the learned SDJM(S), Kokrajhar in connection with Bagribari P.S. Case NO. 48/2023 under section 379/411/34 IPC r/w Section 13(1)/16 of Assam Cattle Preservation Act, 2021. Mr. Das, learned counsel for the applicant submits that the delay occurred in filing the connected revision is not intentional. He further submits that detailed ground of delay has been explained in the petition. Mr. Sarma, learned Additional Public Prosecutor for the State has no objection if the delay is condoned. I have considered the submissions made by the learned counsel for the parties. Page No.# 3/3 The delay has been satisfactorily explained by the applicant and also the learned Additional Public Prosecutor for the State did not raise any objection regarding the prayer of the applicant. Considering all, the delay of 25 days is condoned. The Registry is directed to register the connected revision petition and list it in admission column.
