ORDER Date : 18-01-2024 Heard Mr. U Dutta, learned counsel for the petitioner and Mr. D Das learned Addl. PP, Assam. This is an application under section 439 Cr.P.C filed by the petitioner Pankaj Das who was arrested on 08.12.2023 in connection Page No.# 2/3 with Fatasil Ambari PS Case No.275/2023 under sections 468/471/472 IPC. The informant has alleged in the FIR that he is the owner of a plot of land having a Assam Type house. Thereafter another person named Nirmal Kumar Sarma produced a sale deed purported to have been executed by Late Daran Chandra Deka, the father of the present informant claiming that he had purchased the land on 17.10.1978. The informant has alleged that the said sale deed was a forged sale deed. Thereafter Nirmal Kumar Sarma filed a civil case against the informant and his family members in the Civil Court at Guwahati, similarly the informant and his family members also filed a civil suit against Nirmal Kumar Sarma. Thereafter on 07.11.2018 police arrested Tapash Choudhury on the ground that he used to make false sale deeds. The case diary reveals that the present petitioner is a Homeguard who guards the record room of the local Sub-Registrar Office and from that record room he used to supply the land records to different persons illegally. Mr. D Das, learned Addl. PP submits that some persons in the city are involved in grabbing vacant lands belonging to different persons by manufacturing forged sale deeds and land records. According to Mr. Das, learned Addl. PP, the petitioner is an employee of the local sub registrar office where land records are available. I have considered the submissions advanced by the learned counsel for the parties. Page No.# 3/3 I am of the considered opinion that there are incriminating materials against the present petitioner in the case diary, therefore, the bail application of the present petitioner Pankaj Das is rejected. The bail application stands disposed off. Return the case diary.
