None appears for the respondent No. 3. Mr. Dutta submits that considering the nature of the appeal, the respondent Nos. 1 and 2 need not be heard in this case and therefore, their names should be struck off from the title page of the memo of appeal. Accordingly, the names of the respondent Nos. 1 and 2 are struck off from the title page of the memo of appeal at the risk of the applicant. This is an application u/s 5 of the Limitation Act praying for condonation of delay of 85 days in preferring the appeal. I have found that the delay has been satisfactorily explained. Accordingly, the delay stands condoned.
