26.04.2024 Heard Mr. B Chowdhury, learned counsel for the petitioners. Also heard Mr. P Borthakur, learned Additional Public Prosecutor, Assam. This is an application under Section 438 Cr.P.C., praying for grant of pre-arrest bail to the petitioners, 1. Md. Saddam Ali @ Saddam Hussain, 2. Md. Amir Ali and 3. Md. Bakkar Ali in connection with Mukalmuwa PS case No. 557/2023 (corresponding to GR No. 2017/2023) under Section 328/ 354(B)/ 354(C)/ 323/ 376(D) IPC. Perused the material available on record along with the case diary. This court granted interim protection to the petitioners on 26.02.2024. The petitioners appeared before the Investigating Officer and their statements had also been recorded by the Investigating Officer. Considering the stage of investigation, material so far collected and also considering the fact that the petitioners have co-operated with the investigation, this court is of the view that there is no requirement of custodial interrogation of the petitioners. Accordingly, the present bail application stands allowed. The interim order dated 26.02.2024 is made absolute.
