04.01.2024 When this matter was taken up on the last occasion i.e. 12.09.2023, the following order was passed: "Mr. S.P. Roy, learned counsel for the petitioners has submitted that as the petitioner no. 2 expired on 06.06.2023, he tried to contact the legal representatives of the petitioner no. 2 to continue with the writ petition. As he has not been able to get the necessary instructions, he intends to serve retirement notice for withdrawing his name from the litigation. He has prayed for listing of the case after 6 [six] weeks. Mr. P.K. Roy, learned Standing Counsel, FCI appearing for Mr. A. Chandran, learned Additional Senior Government Advocate, Arunachal Pradesh for Page No.# 3/3 the respondent nos. 1 – 5 and Mr. P.K. Roy, learned Senior Counsel for the respondent nos. 6 – 8 are present. Mr. Roy, learned Senior Counsel appearing for the respondent FCI authorities has submitted that in view of the death of the petitioner no. 2 who is the sole proprietor of the petitioner no. 1 proprietorship concern, the writ petition is, in essence, abated. As sought for by Mr. Roy, learned counsel for the petitioner, list the case on 08.11.2023." Shri J. Das, learned counsel appearing on instructions of Shri SP Roy, learned counsel for the petitioners has submitted that till now no instructions have been received and without further instructions and steps to be taken, they are not in a position to continue with this matter. Also heard Shri SK Chakraborty, learned Standing Counsel, FCI and Ms. K. Dey, learned counsel appearing on instructions of Shri BD Goswami, learned Additional Advocate General, Arunachal Pradesh.
