Judgment

ORDER Date : 22.03.2024 Heard Mr. J. Barman, learned counsel appearing for the Petitioner. I have Page No.# 2/2 also heard Ms. A. Begum, the learned Additional P.P. for the State of Assam. This is an application under Section 438 of the Cr.P.C. in respect of Bokakhat P.S. Case No. 178/2023 under Section 10 of the Pocso Act and under Sections 354/342/448/506 of the Indian Penal Code. The petitioner is a teacher. It is alleged that he had with a criminal intention misbehaved with a 14 year old student of his school. I have gone through the statement of the victim that was recorded under Section 164 Cr.P.C. She has supported the prosecution case against the petitioner. For the aforesaid reasons, the pre-arrest bail application of the petitioner is found to be not satisfactory and stands dismissed and disposed off accordingly.
