Abu Bakkar Siddique v. The State of Assam

ORDER Date : 07 .03. 2024 Heard Mr. S. Rahman, learned counsel for the petitioner and Mr. DP Goswami, learned Addl. Public Prosecutor for the State respondent.

¶2By filling this bail application under Section 438 Cr.P.C., the petitioner has Page No.# 2/2 prayed for pre-arrest bail, who is apprehending arrest in connection with Gauripur P.S. Case No.414/2023 (Corresponding to G.R. Case No. 1738/2023) registered under Sections 354A/ 354B/ 328/ 379/323/307/406/506/34 IPC read with Section 67 of the IT Act.

¶3Case diary is received and perused.

¶4Heard both sides.

¶5It is submitted by Mr. Rahman, the learned counsel for the petitioner that the petitioner is on interim bail dated 10.01.2024 granted by this Court and he is no way involved with the alleged offence and his prayer for pre-arrest bail may be considered.

¶6In this context, Mr. Goswami, the learned Addl. PP has submitted that the police has already submitted charge sheet against the petitioner vide C.S. No. 7/ 2024, dated 20.02.2024.

¶7As the police has already submitted charge sheet against the petitioner, the petitioner may approach before the trial court within a period of 21 days from today seeking regular bail and in the event of filing such application, the learned court below shall dispose of the same in accordance with law.

¶8Till for next 21 days, the interim order granted by this court is extended.

¶9With the above direction, this bail application stands disposed of.
