Heard Ms. M Borah, learned counsel for the petitioners and Mr. K K Parashar, learned Addl. PP, Assam. By this application under section 438 Cr.P.C., the petitioners, namely,

¶1Meher Ali Mondal, 2. Mijanurmandal @ Mizanur Mandal 3. Minara Khatun, 4. Meherul Islam, 5. Rofik Mondal & 6. Nabir Ali Mandal have prayed for granting pre arrest bail who are apprehending arrest in connection with Abhayapuri PS Case No.546/2023 under sections 341/307/326/34 IPC. Page No.# 3/3 It is submitted by the learned Addl. PP that the charge sheet being CS No.30/2024 dated 30.01.2024 in connection with Abhayapuri PS Case No.71/2023 has already been filed by the Investigating Officer after completion of the investigation. In view of the aforesaid, it is provided that the interim order passed earlier by this court 24.01.2024 in respect of the petitioners above named, shall remain in force till the petitioners appear before the learned trial court on receipt of summon and seek regular bail. In the event of such appearance seeking regular bail, the same be considered as per law. Accordingly, this bail application stands disposed of.
