Abdus Salam Sikdar @ Salam Sikdar and 4 Ors v. The State of Assam

ORDER Date : 08.02.2024 Heard Mr. M. Hossain, learned counsel for the petitioners. Also heard Mr. K. Baishya, learned Addl. P.P., Assam for the State respondent. The case was fixed for case diary. However, it is submitted by Mr. K. Baishya, learned Addl. P.P. that charge-sheet has already been submitted vide Charge-Sheet No. 294/2023 dated 30.11.2023 in connection with Fakirganj P.S. Case No. 288/2016 under Sections 147/148/149/447/436/325/379/427 of the IPC. From the order dated 06.02.2024, it appears that the case has already been charge-sheeted. However, no order was passed due to non-appearance for the petitioner on call. Considering the submission made by the learned Addl. P.P. and also considering the fact that charge-sheet has already been submitted, the petitioners are hereby directed to appear before the learned trial Court with an application for regular bail which may be considered by the learned Trial Court in accordance with law.
