Judgment
O R D E R
12.01.2024 The instant writ petition has been filed challenging the list of approved allotees under the Rental Housing Scheme under the Assam State Housing Board, Bhetapara, Maligaon and Hengrabari, all dated
25.02.2016.
¶2However, from a perusal of the writ petition, it reveals that none of the allotees have been made a party in the instant proceedings. Under such circumstances, the writ petition cannot be entertained in view of the necessary parties being not impleaded to the writ petition.
¶3This Court has also taken note of the affidavit-in-opposition filed by the Assam State Housing Board wherein it has been mentioned that as regards one Rita Choudhury who was an allotee of a flat in LIG Building No.E/2 at Ghoramara, she has already been evicted.
¶4In view of the above, taking into account that the petitioner had not impleaded the allotees whose allotments have been put to challenge and also having perused the stand of the respondent authorities that they had duly taken action against those who have been illegally allotted, this Court finds no reason for issuance of a writ in the instant proceedings.
¶5Consequently, the instant writ petition stands dismissed.
