ORDER Date : 08.02.2023 Heard Mr. JUNM Laskar, the learned counsel appearing on behalf of the applicant and Mr. P.R.Sarma, the learned counsel appearing on behalf of the respondents. This is an application filed by the applicant for impleadment of the Additional Central Provident Fund Commissioner as respondent No. 7 to the instant Page No.# 4/4 proceedings taking into account that the instant proceedings cannot be properly adjudicated in absence of the Additional Central Provident Fund Commissioner. The learned counsel appearing on behalf of the respondents submitted that the claim of the applicant is for grant of pension at revised rate after the death of Late Ataur Rahman Mazumdar, the husband of the petitioner. As per the claim of the petitioner, the petitioner is receiving Rs.1,000/- per month. Under such circumstances, for the proper adjudication of the issues involved and taking into account that the records pertaining to the services of Late Ataur Rahman Mazumdar is in the custody of the Additional Central Provident Fund Commissioner (Headquarters), Office of the Additional Central Provident Fund Commissioner, North Eastern region, the impleadment as sought for by the applicant is necessary for proper adjudication of the dispute. Taking into account the said submission so made and the letter dated 18/3/2021, which has been produced by the learned counsel appearing on behalf of the respondents, which is kept on record and marked with the letter X, this Court impleads the Additional Central Provident Commissioner (Headquarters), Office of the Additional Central Provident Fund Commissioner, North Eastern Region, Bhavishyanidhi Bhawan, G.S. Road, Bharalu Bridge, Bhangagarh, Assam, Guwahati-781006 as the respondent No. 7 to the instant writ petition. The Registry shall make necessary correction in the cause title of the writ petition. Accordingly, the interlocutory application stands disposed off.
