ORDER

15.02.2024 Heard Mr B N Gogoi, learned counsel for the petitioner, Azizur Rahman.

¶2The petitioner has filed this application under Section 438 CrPC, with prayer for Page No.# 2/2 bail, apprehending his arrest in connection with Fakirganj PS Case No. 152/2022, registered under Sections 363/365/34 IPC, and additional Section 376(D) IPC, read with Section 4 of the POCSO Act (GR Case No. 1486/2022).

¶3Heard Mr B B Gogoi, learned Additional Public Prosecutor for the State of Assam.

¶4It is submitted at the Bar that the charge sheet has been submitted against the petitioner and it is fairly submitted that the petitioner is willing to cooperate with the trial. The petitioner is also willing to appear before the learned trial Court and apply for regular bail.

¶5In terms of the above observations, the Anticipatory Bail Application is disposed of, with a direction to the petitioner to appear before the learned trial court and apply for bail, which may be considered as per merits of the case.
