Judgment
ORDER Date : 22.08.2024
Mr. A. Dasgupta, learned Senior counsel, assisted by Ms. B. Das, learned counsel for the petitioner submits that though this Court, vide order dated 13.08.2024, had directed him to obtain instructions with regard to the letter dated 03.03.2016, apparently issued by the petitioner, stating that he wanted to withdraw the writ petition, Mr. A. Dasgupta submits that he has been unable to communicate with the petitioner. He submits that he has last contacted the petitioner in the year 2017. Mr. R. Chakravorty, learned counsel for the respondents has handed over a Page No.# 2/2 letter dated 03.03.2016, issued by the petitioner to the Director of Noloni Tea Estate, stating that the petitioner wanted to withdraw the writ petition. The said letter dated 03.03.2016 and the translation thereof is made a part of the record and marked as Annexure-X. In the facts and circumstances of the case, this Court is of the view that there is nothing to doubt the submissions made by the learned counsels for the parties or the genuineness of the above letter. Accordingly, this writ petition is dismissed as withdrawn, as per the letter dated
03.03.2016, with liberty being given to the petitioner to file a fresh, if the letter is found to be fabricated. Send back the LCR.
