Sri Digish Chandra Barman v. Central Bureau of Investigation and Anr

Heard Ms. S. Nazneen, learned counsel appearing on behalf of Mr. Z. Alam, learned counsel for the appellant. Also heard Mr. M. Haloi, learned Standing Counsel, CBI.

It is submitted by Ms. Nazneen, learned counsel appearing on behalf of the appellant, that the appellant-Shri Digish Chandra Barman is already expired and hence, the appeals preferred by the said appellant has already become infructuous.

Page No.# 3/3 Further, from the Office Note dated 19.07.2023, it is seen that a report regarding the death of the appellant-Digish Chandra Barman has been received from the Superintendent of Guwahati Medical College & Hospital, along with a post-mortem report, which is tagged with the case record. On perusal of the said report, it is seen that the appellant expired on 18.12.2020 and one U/D Case No. 19/2020, dated 18.12.2023, was also registered.

Thus, from the report received from the Superintendent, Guwahati Medical College & Hospital, it is seen that the appellant-Digish Chandra Barman has already expired and accordingly, the present appeals and the connected interlocutory application, being Crl. A./127/2016, Crl. A./128/2016 & I.A. (Crl.)/22/2016, are hereby stand disposed of as become infructuous. JUDGE Comparing Assistant
