¶3Taking into account the above, this Court is of the opinion that the Petitioner is not interested in the instant proceedings for which the instant proceedings stands dismissed for non-prosecution.

¶4The Court of the learned District Judge, Baksa shall proceed with the disposal of T.S.(M) No.09/2022 in accordance with law.

¶5The Registry shall intimate the learned Court below about passing of the instant order.

¶6Interim order passed on 03.02.2023 stands vacated.
