¶3The said case has been registered on the basis of one F.I.R. lodged by SI Bipul Chanda, on 27.12.2023. The essence of allegation made in the FIR is that on 26.12.2023, at about 4:15 pm, on receipt of an FIR, about an accident, that took place at T.E. Ms. Begum further submits that the IO has collected some incriminating materials against the applicants and that the investigation is still going on and therefore, it is contended to dismiss the petition.

¶6Having heard the submission of learned Advocates of both sides, I have carefully gone through the petition as well as the documents placed on record and also perused the Case Diary produced before this Court, with the assistance of learned Additional Public Prosecutor.

¶7The case diary indicates that the IO has collected some incriminating materials against the applicants, in support of the allegation made in the FIR. However, it appears that the IO has achieved significant progress of the case. It also appears that the applicant No. 3 appeared before the IO.

¶8In view of above and having considered the nature and gravity of the offence and punishment prescribed for the same and also considering the stage of investigation, this Court is of the view that further custodial interrogation of the applicants may not be required, in the interest of investigation.

¶9Accordingly, it is provided that in the event of arrest of the applicant, in connection with the Hailakandi P.S.
