Lenancy Tissopi v. The State of Assam

ORDER

05.03.2024 Heard Mr. M. Z Shah, learned counsel for the petitioner. Also heard Mr. K.K. Parashar, learned Addl. P.P, Assam. This is an application under Section 438 of Cr.PC, 1973 for granting pre-arrest bail to the accused/petitioner, namely Lenancy Tissopi, who is apprehending arrest in connection with Hamren P.S Case No. 29/2023 registered under Sections 341/325/307/34 of IPC. The Case Diary as called for is placed before this Court. It may be mentioned that by Order dated 02.02.2024, this Court grant the privilege of interim pre-arrest bail to the petitioner subject to the condition. Mr. K.K. Parashar, learned Addl. P.P submits that the Case Diary shows that the petitioner appeared before the Investigating Officer and got her statement recorded under Section 161 Cr.PC as per the interim pre-arrest bail granted earlier. He further submits that as per the inquiry report, the injury sustained by the victim is simple in nature. As such, this Court finds that custodial interrogation of the petitioner may not be required in the interest of the on-going investigation into the case. Accordingly, the interim pre-arrest bail granted by Order dated 02.02.2024 is hereby made absolute, subject to the following conditions:- Page No.# 3/3

(i) That the petitioner shall cooperate in the investigation.

(ii) That the petitioner shall not directly or indirectly make any inducement, threat or promise to any other persons who may be acquainted with the facts of the case so as to dissuade such persons from disclosing such facts to the Court or to any Police Officer.

(iii) That the petitioner shall not leave the jurisdiction of jurisdictional Court without prior written permission. With the above observation and direction, the anticipatory bail application stands disposed of. JUDGE Comparing Assistant
