Khudeja Begum v. The State of Assam

Heard Mr. P. Das, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Addl. P.P for the State respondent. This is an application under Section 438 of the Cr.PC, 1973 praying for granting of pre-arrest bail to the petitioner, i.e., Khudeja Begum in connection Page No.# 2/2 with Chhaygaon P.S. Case No. 26/2023 registered under Sections 304 (B)/34 of IPC. Mr. P. Borthakur, learned Addl. P.P submits that in the meantime, Charge-sheet has been submitted vide C.S No. 246/2023 dated 18.07.2023. Mr. P. Das, learned counsel for the petitioner submits that the petitioner is willing to appear before the Trial Court and co-operate in the on-going trial. Considering the above, this anticipatory bail application is disposed of with a direction to the petitioner to appear before the Court of CJM, Amingaon within a period of 15 days and till then, he shall not be arrested. Upon his appearance, the Court of CJM, Amingaon shall consider the prayer for bail in accordance with law. This disposes of the anticipatory bail application. JUDGE Comparing Assistant
