Md. Bhaijan Ali v. The State of Assam

ORDER Date : 13-03-2024 Heard Mr. M. Kalita, learned counsel for the petitioner. Also heard Mr. K.K. Parashar, learned Additional Public Prosecutor for the State respondent.

¶2This is an application under Section 438 of the Code of Criminal Procedure, 1973 seeking pre-arrest bail of the petitioner i.e. Md. Bhaijan Ali, who is apprehending arrest in connection with Tinsukia Police Station Case No. Page No.# 2/2 1024/2020 corresponding to G.R. No. 1768/2020 registered under Sections 448/376 of the Indian Penal Code, 1860.

¶3Mr. K.K. Parashar, learned Additional Public Prosecutor submits that in the meantime charge sheet has been filed vide CS No. 567/2023.

¶4It appears that investigation has been completed.

¶5In view of the above, this Anticipatory Bail application is disposed of with a direction to the petitioner to appear before the learned Court of Chief Judicial Magistrate, Tinsukia within a period of 10 (ten) days from today and till then, he shall not be arrested. Upon the appearance, the learned Court of Chief Judicial Magistrate shall consider the prayer for bail on its own merit.

This disposes of the anticipatory bail application.
