Heard Ms. P. Bhattacharya, learned counsel for the appellant. Also heard Mr. B. Kalita, learned counsel for the respondent Nos. 1, 2 & 3.

It is seen that vide order dated 08.02.2024, the matter was sent for mediation before the Gauhati High Court Mediation Centre and accordingly it is submitted by the learned counsels appearing on behalf of both sides that the matter has already been settled before the Mediation and the report has been filed by the Mediator-Smti Nandita Bharali supported with the agreement of settlement with the agreed terms and conditions. It is also seen that both the Page No.# 3/3 parties also put their signatures in the said agreement on 27.02.2024 before the Gauhati High Court Mediation Centre.

It is submitted by Ms. P. Bhattacharya, learned counsel for the appellant, that after the settlement of their dispute before the Mediation Centre, both the parties agreed to get their shares from the ONGC, who is ready and willing to pay the amount which has been stayed vide order dated 04.03.2022, passed in I.A.(Civil) No. 688/2020.

In this context, Mr. B. Kalita, learned counsel for the respondent Nos. 1, 2 & 3, also submitted that the matter has already been amicably settled between the parties before the Mediation Centre and they are ready to abide by all the terms and conditions as per the settlement agreement.

In view of above and considering the settlement between the parties before the Mediation Centre, the present intestate case is accordingly disposed of. Consequently, the interim order dated 04.03.2020, passed in I.A.(Civil) No. 688/2020, stands vacated.

The agreement of settlement before the Mediation be made a part of record.
