ORDER
05.03.2024 Heard Mr. M. Rahman, learned counsel for the petitioner. Also heard Mr. D. Das, learned Addl. P.P, Assam. This is an application under Section 438 of Cr.PC, 1973 praying for granting pre-arrest bail to the accused/petitioner, namely Tazum Uddin @ Tazumuddin @ Md Tazumuddin, who is apprehending arrest in connection with North Lakhimpur P.S Case No. 1118/2020 registered under Sections 120(B)/417/420/511/489(A)/489(C)/489(D) of IPC. The case of the prosecution is that the informant on 19.11.2020, upon receiving an information to the effect that the petitioner has been running a large scale business of fake currency notes by printing fake currency notes along with fake gold in collaboration with some miscreants from his house since many days, raided the house of the petitioner and during the search, recovered objectionable articles alongwith fake currency notes, fake currency notes printing machine and fake gold. Accordingly, a case was registered. Mr. M. Rahman, learned counsel for the petitioner submits that the petitioner is totally innocent and is not connected with the above case. Mr. D. Das, learned Addl. P.P on the other hand strongly opposes the prayer for anticipatory bail. He further submits from the materials available in the Case Diary that there are incriminating materials collected by the Page No.# 3/3 Investigating Officer against the petitioner. He further submits that various objectionable articles including fake currency notes, fake currency notes printing machine and fake gold were recovered from the house of the petitioner in presence of witnesses. I have heard the submissions made at the bar and have perused the materials available on record. It appears that there are sufficient materials against the petitioner in connection with the above noted case. It further appears that the investigation is at a crutial stage. Considering the gravity of the offence, this Court is not inclined to grant the prayer of anticipatory bail at this stage. As such, the anticipatory bail application stands rejected. With the above observation and direction, the anticipatory bail application stands disposed of. JUDGE Comparing Assistant
