ORDER Date : 17.02.2024 Heard Mr. S. Alom, learned counsel for the petitioner. Also heard Mr. S. M. T. Chistie, learned standing counsel for the Elementary Education Department and Mrs. R. Bora, learned standing counsel for the SSA, Assam as well as Mr. S. R. Rabha, learned standing counsel for the BTC.

The petitioner by way of instituting the present proceeding has assailed the inaction on the part of the respondent authorities of SSA more particularly the Mission Director, Axom Sarba Siksha Abhijan Mission, Assam in not allotting the petitioner school the DISE code number. The petitioner had earlier approached this Court basing on the same grievance by way of instituting WP(C) 3765/2023, and this Court vide order dated 30.06.2023 disposed of the said writ petition requiring the Mission Director Axom Sarba Siksha Abhijan Mission, Assam to dispose of the representation as preferred by the petitioner on 05.04.2023 on the said aspect of the matter. The Mission Director, Axom Sarba Siksha Abhijan Mission, Assam thereafter vide order dated 16.10.2023 on consideration of the said representation of the petitioner had come to a conclusion that the school of the petitioner satisfies all requisite criteria for being allotted UDISE code number and accordingly, it was decided that the petitioner school, i.e. Gangadhar Memorial Venture ME School be allotted DISE Page No.# 4/5 code of the year 2023-24.

The grievance in the present writ petition is that inspite of the order dated 16.10.2023 passed by the Mission Director, Samagra Shiksha, Assam, the DISE code is yet to be given to the petitioner school.

In view of the above, this writ petition stands disposed of by directing the Mission Director, Samagra Shiksha, Assam to allot to the petitioner school the DISE code in terms of the order dated 16.10.2023 within a period of seven days from the date of receipt of the certified copy of this order.

The petitioner is required to submit the certified copy of this order along with the representation, enclosing the copy of the said order dated

16.10.2023 before the Mission Director, Samagra Shiksha, Assam and thereafter the Mission Director is to comply with the direction given hereinabove. The decision already been arrived at by the Mission Director, Samagra Shiksha, Assam to allot the DISE code to the school in question, there exist no requirement of any further examination in the matter and accordingly, the Mission Director Samagra Shiksha, Assam shall forthwith allot to the petitioner school DISE code within the period as prescribed hereinabove.

With the above observation and direction, the writ petition stands Page No.# 5/5 allowed. JUDGE Comparing Assistant
