On the Death of Goma Dhar Her Legal Heir Smti Neha Dhar v. Oriental Insurance Co. Ltd. and 2 Ors

Heard Mr. S. Das, learned counsel for the applicant. Mr. S. Dutta, learned Senior counsel assisted by Mr. S. Dutta, learned counsel for the respondent No.1/Insurance Company. The application has been filed for withdrawal of the 50% of the awarded amount, amounting to Rs. 3,41,500/-(Rupees Three Lakh Forty One Thousand Five Hundred only), which has been deposited by the Insurance Company in terms of the order dated 01.08.2022, passed by this court in I.A.(Civil)/1927/2022 in MACApp. No. 344/2022. It is submitted that the 50% of the awarded amount has been deposited before the Registry of this court. The Registry shall release the 50% of the awarded amount, amounting to Rs. 3,41,500/-(Rupees Three Lakh Forty One Thousand Five Hundred only), if the same is deposited before the Registry against proper verification and after the applicant is identified by the counsel. The petition stands disposed.
