Lucky Ahmed Barlaskar v. The State of Assam

ORDER

16.02.2024 Heard Mr. P K Deka, learned counsel for the petitioner as well as Mr. D. Das, learned Additional Public Prosecutor, Assam. This is an application filed under Section 439 CrPC by the petitioner, namely, Shri Lucky Ahmed Barlaskar, for release on bail who was arrested in connection with Silchar P.S. Case No. 4067/2020 registered under Sections 120B/420/468/417 IPC read with Section 471 of the said Page No.# 2/2 Code. From the contents of the peculiar FIR, it could be understood that Police Officer filed a report in respect of Section 144 of the CrPC and later on, the said proceeding was converted to a proceeding under Sections 145 and 146 (i) of the CrPC. The complainant has alleged that some persons forged some documents probably in respect of some properties though nothing has been clearly mentioned in the FIR. From the forwarding report, it appears that Police arrested the present petitioner on the ground that he was involved in many cases relating to land grabbing. It is clear from the forwarding report that only on the basis of suspicion the present petitioner has been arrested by the Police. I find that there are no elements in this case to involve the petitioner in this case. Hence, the prayer for bail is allowed. Accordingly, it is directed that the petitioner Shri Lucky Ahmed Barlaskar be released on bail of Rs.25,000/- who was arrested in connection with Silchar P.S. Case No. 4067/2020 registered under Sections 120B/420/468/417 IPC read with Section 471 of the said Code with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Cachar, Silchar.
