19.08.2024
Heard Mrs. N. Saikia, the learned counsel appearing on behalf of the petitioner. Ms. G. Hazarika, the learned counsel appears on behalf of the respondent No.1 and Mr. N. Goswami, the learned counsel appears on behalf of the respondent No.2. None appears on behalf of the respondent No.3.
¶2The petitioner has approached this Court seeking a mandamus upon the respondent Nos.1 & 2 to grant settlement in favour of the petitioner the plot of land bearing Dag No.465 which as per the petitioner is a Government land. It has however been submitted that the petitioner who was in occupation of the said land has been evicted by the respondent No.3 authorities in the year 2021. It is the further case of the petitioner that an application was filed on 30.04.2015 seeking allotment which has not been considered by the Respondent Nos.1 & 2 for which the petitioner had approached this Court.
¶3Taking into account that the Government of Assam has already come up with the Land Policy of 2019 whereby certain policy has been formulated for settlement of land as well as the procedure for application seeking settlement had been stipulated, this Court disposes of the instant writ petition thereby granting the liberty to the petitioner to submit application either through offline or online mode to the District Commissioner, Nagaon. It is observed that if the petitioner files such application, the same be considered as per the extant provisions as well Page No.# 3/3 as the Land Policy of 2019.
¶4With the above observations and directions, the instant writ petition stands disposed of.
