The Oriental Insurance Company Ltd v. Tamech Rabha and 3 Ors

ORDER The case is put up before the National Lok Adalat. The Insurance Company is represented by its officials. The claimants, are duly present along with the engaged counsel. It is submitted that the earlier awarded amount was Rs.13,06,680/-(Rupees thirteen lakhs six thousand six hundred eighty) only. After negotiation, both the parties are agreed to settle the matter on an amount of Rs. 13,00,000/-(Rupees thirteen lakhs) only as full and final settlement. Accordingly, the Oriental Insurance Company Ltd. is directed to deposit the settlement amount of ₹13,00,000/-(Rupees thirteen lakhs) only before the learned MACT, Goalpara, within a period of 1

(one) month from today. Out of the said amount, Rs.5,00,000/- (Rupees five lakhs) shall be deposited in a nationalized bank in the name of Claimant No. 2, Bachi Bala Rabha (mother of the deceased); Rs.2,00,000/- (Rupees two lakhs) each shall be deposited in any nationalized bank for Claimants No. 3 and 4, namely Anima Rabha (sister of the deceased) and Sabyasing Rabha (brother of the deceased), until they attain the age of majority. Thereafter, the balance amount shall be released in favour of Page No.# 4/4 Claimant No. 2, Bachi Bala Rabha (mother of the deceased). Accordingly, the claimant shall be at liberty to withdraw the same on being proper verification and identification by the engaged counsel of the case. Registry is further directed to return the statutory deposited amount of Rs. 25,000/- (Rupees twenty five thousand) only to the Insurance Company, if any. The MAC Appeal is disposed of.
