Judgment

ORDER

28.02.2024 Heard Mr. B.C. Das, learned Sr. Counsel assisted by Mr. A.R. Shome, learned counsel for the petitioner. Also heard Mr. S.S. Roy, learned counsel for the respondents.

¶2The case of the petitioner is that the petitioner participated in a proceeding for selection of retail outlet (petrol pump dealership). In the process the petitioner was requested by the respondents, by its communication dated

17.01.2024, to upload certain rectified documents by 07.02.2024. However, admittedly the petitioner could not file such rectified documents by 07.02.2024 and accordingly, by a communication dated 09.02.2024, the candidature of the petitioner was rejected, being not eligible.

¶3However, an option was given to the petitioner to file a representation, if aggrieved by such decision. Accordingly the petitioner preferred a representation on 17.02.2024 and the grievance of the petitioner is that the representation has not yet been disposed of by the respondents.

¶4Mr. S.S. Roy, learned counsel for the respondents has submitted a letter dated 19.02.2024, issued by the Bharat Petroleum Corporation Ltd., which shows that the petitioner's representation has been rejected.

¶5In view of the above, the writ petition has become infructuous. However, the petitioner is at liberty to challenge the said letter, if so advised. Page No.# 3/3

¶6The letter dated 19.02.2024 is made a part of the record and marked as Annexure-X.
