Heard Ms. P Barua, learned counsel for the petitioner and Mr. P Borthakur, learned Addl. PP, Assam. By this application under section 438 Cr.P.C., the petitioner, namely, Page No.# 2/2 Rekibuddin Ahmed has prayed for granting pre arrest bail who are apprehending arrest in connection with Basistha PS Case No.844/2023 under sections 365/343/376/383 IPC. It is submitted by the learned Addl. PP that the charge sheet being CS No.138/2024 dated 08.03.2024 in connection with Basistha PS Case No.844/2023 has already been filed by the Investigating Officer after completion of the investigation. In view of the aforesaid, it is provided that the interim order passed earlier by this court on 22.02.2024 in respect of the petitioner above named, shall remain in force till the petitioner appear before the learned trial court on receipt of summon and seek regular bail. In the event of such appearance seeking regular bail, the same be considered as per law. Accordingly, this bail application stands disposed of.
