This is an application under Section 438 of CrPC for grant of anticipatory bail to the petitioner i.e. Jahirul Islam @Johirul Islam, who is apprehending arrest in connection with Bilasipar PS Case No. 356/2023 under Section 9/11(i) of Prohibition of Child Marriage Act, 2006 r/w Section 6/17 of POCSO Act. It is submitted by Mr. D.P. Goswami, learned APP for the State respondent that chargesheet has been filed vide CS No. 529/2023 dated 25.12.2023. Considering the aforesaid endorsement, this Court is of the considered view that this anticipatory bail can be disposed of with a direction that the petitioner shall appear before the Court of Addl. Sessions Judge, Bilasipar within 10 days from today and till then, the petitioner shall not be arrested. Ordered accordingly. It is needless to clarify that upon his appearance, the learned Trial Court is at liberty to proceed in accordance with law. The Anticipatory Bail application stands disposed of.
