Judgment
ORDER Date : 09-02-2023 There is no representation on behalf of the petitioners today on call. Ms. S. Sharma, learned Junior Government Advocate for the State respondent is Page No.# 3/4 present.
¶2The petitioners, 5 [five] in nos., have approached this Court by the instant writ petition under Article 226 of the Constitution of India seeking inter alia a direction to the Branch Manager, Punjab National Bank, Kaniha Branch ['the respondent no. 7] to accord sanction to the petitioners' projects for the Credit Linked Subsidy Programme under the Prime Minister's Employment Generation Programme [PMEGP] forthwith for the year : 2013 -2014. It has been stated that the PMEGP is a central sector scheme administered by the Ministry of Micro, Small and Medium Enterprises [MoMSME] [the respondent no. 1]. At the State level, the PMEGP scheme is implemented through [i] State Khadi and Village Industries Commission [KVIC] [the respondent no. 3], [ii] District Industries Centres [DICs] [the respondent no. 4], [iii] State Khadi and Village Industries Boards [KVIBs] [the respondent no.5] and [iv] the concerned bank.
¶3It has been projected in the writ petition that in the year 2014, the respondent no. 7 was informed by the respondent no. 5 that the projects of the petitioners had been recommended by the District Task Force Committee. Forwarding the projects, the respondent Bank was requested for consideration of the projects at their end. While forwarding the projects, the respondent no. 5 mentioned that the projects should be considered strictly on its merits, if found viable and bankable.
¶4It is the case of the petitioners that despite the projects being forwarded, the respondent Bank did not accord sanction and extend any financial assistance to the petitioners.
¶5On perusal of the previous orders, it is noticed that when the writ petition Page No.# 4/4 was listed on earlier occasions i.e. on 15.05.2019 and 24.01.2023, none appeared for the petitioners on call on those occasions.
¶6Having noticed repeated absence of the petitioners on three occasions, this Court is persuaded to take a view that the petitioners are not interested to pursue this writ petition. In such view of the matter, this writ petition stands dismissed for non-prosecution.
