ORDER

The case is put up before the National Lok Adalat. The Insurance Company is represented by its officials.

The claimant is duly present along with engaged counsel. It is submitted that the total awarded amount was Rs. 12,24,348/- (Rupees twelve lakhs twenty-four thousand three hundred fourty-eight) only and out of which, the Insurance Company has already deposited an amount of Rs. 6,12,174/- (Rupees six lakhs twelve thousand one hundred seventy-four) only, which has already been withdrawn by the claimant.

Both the parties are agreed to settle the matter on an amount of Rs 12,70,000/- (Rupees twelve lakhs seventy thousand) only as full and final settlement and since an amount of Rs. 6,12,174/- (Rupees six lakhs twelve thousand one hundred seventy-four) only has already been deposited by the Insurance Company, they are ready to pay the remaining amount of Rs. 6,57,826/- (Rupees six lakhs fifty-seven thousand eight hundred twenty-six) only towards the settlement amount. Accordingly, as agreed to by both the parties, the appellant/New India Assurance Company Ltd. is hereby directed to deposit the remaining amount of Rs. 6,57,826/- (Rupees six lakhs fifty-seven thousand eight hundred twenty-six) only before the Court of learned Tribunal, MACT, Silchar within 1

(one) month from today and the claimant will be at liberty to withdraw the same on being proper verification and identification by the concerned counsel of the case.

Registry shall return the statutory deposit, if any to the Insurance Company.

The appeal stands disposed of in terms above.
