Indranuj Kashyap v. The State of Assam

ORDER Date : 26-02-2024 Heard Mr. K. N. Choudhury, learned Senior Counsel assisted by Ms. R. R. Kakati, learned counsel for the applicant. Also heard Mr. M. Phukan, learned Public Prosecutor for the State respondent. This application, under Section 438 Cr.P.C. is preferred by the applicant, namely, Sri Indranuj Kashyap who has been apprehending arrest in connection with Vigilance P. S. Page No.# 2/2 Case No. 8/2023, u/s 13(1)(b),13(2) of Prevention of Corruption Act. After hearing the learned Advocates of both side, learned Public Prosecutor was directed to obtain necessary instruction from the Officer-in-Charge of concerned P.S as to whether the present applicant is required in connection with Vigilances P. S. Case No. 8/2023, u/s 13(1) (b),13 (2) of Prevention of Corruption Act. Today, the learned Public Prosecutor has produced a written report from the Officer-in-charge, Vigilance P.S to the effect that the applicant is not required in connection with Vigilances P. S. Case No. 8/2023 and he was called to the Police Station, as a witness only. Since the applicant not required in the vigilance P. S. Case No. 8/2023 and since he was called as a witness only, this anticipatory bail application become infructuous, as there is no apprehension of arrest and as such, the same stands closed. The report submitted by Mr. M. Phukan, learned P.P. shall be a part of the record.
