Heard Ms. P. Bhattacharya, the learned counsel appearing on behalf of the Petitioner and Ms. A. Gayan, the learned CGC appearing on behalf of the Respondent Nos. 1, 2 and 3. I have also heard Ms. S. Sharma, the learned Government Advocate appearing on behalf of the Respondent No.4.

¶2Ms. P. Bhattacharya, the learned counsel for the Petitioner submits that she may be permitted to withdraw the instant writ petition taking into account that the proceedings herein is initiated against an order passed by the learned Additional District Judge, Golaghat. However, she further submits that she may be permitted to again assail the said order in a proceedings under Article 227 of the Constitution.

¶3Taking into account the above, the instant petition stands closed on withdrawal. Page No.# 3/3

¶4Liberty however is given to the Petitioner to challenge the order dated 30.01.2023 passed in Title Appeal No.3/2016 under Article 227 of the Constitution.

¶5Interim order passed earlier stands vacated.
