The instant application has been filed by the Petitioner for recalling of the order dated 05.02.2024 in view of the fact that this Court had committed an error in rendering the contempt proceedings infructuous on the basis of the order dated 11.10.2023 passed in Review Petition No.194/2019. Page No.# 2/2

¶2The learned counsel for the Applicant submits that the order dated

11.10.2023 passed in Review Petition No.194/2019 is against the order dated

26.02.2019 passed in WP(C) No.6126/2013.

¶3Taking into account that there was a mistake committed by this Court and in view of the well settled principles of law that due to the fault of the Court a litigant should not suffer, this Court recalls the order dated 05.02.2024 passed in Contempt Case No.700/2022 and restores the said contempt proceedings to the file of this Court.

¶4Accordingly, I.A. stands allowed.
