On the Death of Mahibul Hussain His Legal Heirs Rashan Ara Begum v. Abdul Gani,

Heard Mr. B. Baruah, learned counsel for the applicant.

¶2This interlocutory application, under Order XXII Rules 3/4, read with Section 151 of the CPC, is preferred by the applicant for substitution of the legal heirs of the appellant No.2 Late Mahibul Hussain.

¶3Mr. Baruah, learned counsel for the applicant submits that the appellant No. 2, Mahibul Hussain suffered demise on 10.06.2014, and that their legal heirs are required to be impleaded in his place.

¶4Having considered the submissions of learned counsel for the applicant, this Court is inclined to allow this application.

¶5Accordingly, it is provided that the names of the legal heirs of Late Mahibul Hussain be impleaded in the connected appeal MAC RSA 50/2014.
