ORDER Date : 21.03.2024
Heard Mr. N.J. Dutta, learned counsel for the petitioner. Also heard Mr. B.B. Gogoi, learned Additional Public Prosecutor appearing for the State. This is an application filed under Section 439 Cr.P.C., seeking bail by the petitioners, namely, Abdul Salam, in connection with Sukchar P.S. case No. 10/2024, registered under Section 143/341/333/353/307/379/411 Page No.# 2/3 IPC r/w Section 13(1)/16 of ACP Act, 2021. The learned counsel for the petitioner submits that the petitioner has been languishing in jail hazot since 04.02.2024. The allegation against the petitioner is totally false and fabricated and he has no nexus with the alleged offence and smuggling groups. The petitioner was not present at the time of incident. The learned counsel for the petitioner also pointed out the grounds of arrest wherein it disclosed that as the petitioner was previously involved in attacking police personnel and his involvement in connection with Sukchar P.S. C/No. 266/23, therefore, he was arrested in connection with this case. Considering the period of detention as well as the background of the case, the petitioner may be enlarged on bail. On the other hand, Mr. Gogoi, learned Additional Public Prosecutor for the State has produced the case diary along with injury report. He further submits that the injury sustained by the victim is simple in nature caused by blunt object. Therefore, on considering the length of detention, the petitioner may be enlarged on bail. I have considered the submissions made by the learned counsel for the parties. I have also perused the case diary. Considering the background of the case as well as the length of detention of the petitioner, this Court is of the view that further custodial interrogation of the accused-petitioner is not necessary for the purpose of investigation of the case. Accordingly, the accused-petitioner, named above, shall be released on bail in connection with Sukchar P.S. case No. 10/2024, registered under Section 143/341/333/353/307/379/411 IPC r/w Section 13(1)/16 of ACP Act, 2021, on furnishing bail bond of Rs.20,000/- with a suitable surety of Page No.# 3/3 the like amount to the satisfaction of learned CJM, South Salmara, Mankachar, Assam.
