Judgment

ORDER Date : 18-03-2024 Heard Mr. R. Islam, learned counsel appearing for the Petitioners. Also heard Mr. R.J. Baruah, the learned Additional P.P. for the State of Assam. Page No.# 2/2 This is an application under Section 439 of the C.r.P.C. in respect of Moirabari P.S. Case No. 18/2024 under Sections 120(B)/419/420/406/ 467/468/471/34 of the Indian Penal Code read with Section 66C/66D of I.T. Act. An officer of Axis Bank lodged an FIR before the police alleging that some unknown persons have committed fraud by securing loans after they applied for loans online. Mr. Baruah submits that there are incriminating materials against the present two Petitioners. Mr. Ahmed, on the other, submits that the Petitioners have already spent 40 days in judicial custody and therefore their bail application should be considered. I have given my anxious consideration to the submissions made by the learned counsel for both sides. This Court is of the opinion that the offence committed by the Petitioners is a serious one causing loss of public money. Some more investigation is required into this case. Therefore, at this stage the bail application of the Petitioners is found not to be satisfactory and stands rejected accordingly. The CD shall be returned. Accordingly, the bail application stands disposed off. JUDGE Comparing Assistant
