He has completed the statutory period prescribed under law and therefore, he seeks to enforce his right under Section 167(2) of the Cr.P.C. and be enlarged on default bail as no charge-sheet has been filed till date. The learned counsel for the accused-petitioner submits that he will abide by all the conditions that may be imposed by this Court.
¶6The learned counsels for the parties have been heard. The accused-petitioner was arrested in connection with Dalgaon P.S. Under Section 366 of the IPC, the punishment prescribe is for a term which may extend to 10 years and also be liable to fine. ¶7It is not in dispute at the bar that the statutory period of detention in respect of the contravention under Section 22(b) of the NDPS Act is 60 days. The petitioner has been in judicial custody from 12.06.2021 i.e., for 62 days, which is admittedly more than the statutory period for detention mandated. The learned counsel Addl. PP has submitted that no Charge-sheet has been filed as on date nor has any application been filed seeking extension of the period of detention as on date. As has been held in Rakesh Paul Vs. State of Assam, reported in (2017) 15 SCC 67 and M. Ravindran Vs. Intelligence Officer, Directorate of Revenue Intelligence, reported in (2021) 2 SCC 485 when the accused applies for bail under Section 167(2) Cr.P.C. upon expiry of the statutory period, the Court must release him on bail forthwith. The rights of the accused-petitioner under Section 167 can also be enforced orally as has been held by the Apex Court in Rakesh Paul (Supra). Considering the length of detention and considering the prayer made by the learned counsel for the accused-petitioner invoking his right under Section 167(2) of the Cr.P.C., the accused-petitioner is directed to be released on bail.
¶8Accordingly, invoking the provisions of Section 167 Cr.P.C., this Court is of the view that the accused-petitioner is required to be released on bail as he has completed the mandatory period. Page No.# 5/5
